Tribunal decision
Good morning from Nova Scotia. I have been travelling, but getting
all the good news from friends and colleagues in PEC. Today I am writing specifically to say: Thank You. I
have included a little overview of Prince Edward County Field Naturalists (PECFN) activities over the past 2-3 years for some
of you who may be new to our struggle to save Ostrander Point. Over
the past few years PECFN has been working hard to save Ostrander Point from development. We have responded to Ministry
of the Environment opportunities to comment on the IWT project proposed by Gilead. We have attended Gilead open houses
and sent criticisms to the company. We have attended County Council and written and paid for a blog on Countylive.ca.
We have initiated and promoted a resolution of the 2011 AGM Ontario Nature to increase the set back distance of wind turbines
from shorelines. All of this has been to make it clear that we are against wind turbine development in Important Bird
Areas, areas of sensitive habitat – alvar, woodland, meadow and wetland - and wherever development would adversely impact
endangered species. In spite of all our hard work and lobbying the Ministry of the Environment approved the Gilead project
at Ostrander Point. We were given 15 days to appeal the approval to the Environmental Review Tribunal over the Christmas
holidays in 2012. Of course we appealed because we are committed to do everything we can to keep the integrity of the
PEC South Shore Important Bird Area intact. Over the past 7 months
we have been privileged to have excellent legal representation from Natalie Smith and Eric Gillespie. We have had marvelous
witnesses testify to the importance of Ostrander Point as a major migratory and stopover place for millions of birds, bats
and butterflies; as a globally imperilled alvar habitat and as the home of at least 2 endangered species. Our work has not been in vain. The Environmental Review Tribunal has given us a decision that upholds
our appeal based on the presence of Blanding’s Turtles at Ostrander Point and that Gilead has not been able to assure
their safety. PECFN is a small group of committed naturalists.
We do not have any professional fund raising experience. All we have been able to do is to ask people to help us pay
for the appeal. Citizens of Prince Edward County and people from all across Canada have come forward with funds to help
pay for the appeal. We are humbled by this and truly grateful. Your contribution has helped us to Save Ostrander
Point. Thank you. Of course we need more money. At
this point our legal bills are about 50% funded. We may have to defend Ostrander Point further if Gilead or the Ministry of
